Schmitt’s theory of the state of exception and the emergency powers of the president. In order to clarify the relationship between constitutionalism, and the exceptional power of the president, I analyze Schmitt’s major political and juridical works, Politische Theologie and Die Diktatur des Reichsprasidenten.\n　In particular, this article investigates Schmitt’s interpretation of Article 48, Section 2 of the Weimar Constitution in comparison with that of other prestigious scholars of public law such as G. Anschutz, Hugo Preuβ, R. Grau, and Erbin Jakobi. This clarifies Schmitt’s position among public lawyers of the Weimar Republic.\n　Schmitt constructed the emergency powers of the president in the Weimar Constitution not as a sovereign dictatorship, but as a commissarial one.\n　Concerning the relationship between dictatorship and constitutionalism, Schmitt did not attack constitutionalism as such, but set the extraordinary power in the context of constitutionalism.
