The eminent Austrian jurist Hans Kelsen produced several draft constitutions, causing heated controversy among several political parties and resulting in a range of views from Austrian people being included in the 1920 Constitution.  On the other hand, the 1920 Constitution also received important concepts such as popular sovereignty, constitutionalism, and equality before the law from the Kremsier Draft Constitution of 1849 (der Kremsierer Verfassungsentwurf in 1849) which was written immediately after the Austrian March Revolution of 1848.  Here I describe the writing, contents and historical background of the 1920 Constitution and also the 1929 amendment, Hans Kelsen’s view and Austrian constitutionalism (Legalitätsprinzip).}, pages = {1--17}, title = {オーストリア1920年連邦憲法とハンス・ケルゼン―オーストリア法治主義(Legalitätsprinzip)の展開―(4・完)}, volume = {27}, year = {2013}, yomi = {オク, マサツグ} }
