This question is addressed by reconstructing his concept of a state of exception or a state of emergency from the First World War, through the Weimar and Nazi period, to the Federal Republic of Germany under Basic law Bonn (Grundgesetz für die Bundesrepublik Deutschland).\n As this is the first article in the series, Schmitt’s approach to the state of exception and emergency powers is examined by first considering martial law in the First World War, and next his famous work Diktatur (1921). In Diktatur he preferred a commissarial dictatorship to protect and preserve the Weimar constitutional system against attack from outside and inside, and objected to the revolutionary attempt as the sovereign dictatorship.\n My conclusion is that Schmitt was critical toward the praxis of martial law in First World War Germany, which threatened the separation of powers.Therefore, in the Weimar Republic, he wanted to make emergency powers of the president under Article 48 compatible with the constitutionalism of the Weimar Constitution. It is true that his view on the scope of emergency powers under the Article 48 is wider than that of other prestigious scholars of public law like G. Anschüz and H.
